Bastian Best is a computer scientist and works as a patent engineer and a Patent Attorney trainee in one of Europe’s leading intellectual property law firms.

Technical expertise

On a technical level, Bastian Best specializes in the fields of computer software and hardware, telecommunications and computer science in general. He has in-depth practical experience in the prosecution of patents concerning computer-implemented inventions (aka “software patents”) in Germany, Europe, the U.S.A. and China. Examples include network security (e.g. authorization protocols), XML database systems (e.g. methods for query processing, optimization and indexing), service-oriented architectures (SOA), Complex Event Processing (CEP), mainframe modernization products, secure pay-TV appliances and mobile telephony.

Moreover, Bastian Best has experience in the prosecution of patents concerning mechanical, medical-technical and chemical subject-matter, spanning sports shoes, golf shoe cleats, door framings, automotive emergency breaking systems, hypodermic syringes and synthetic multicomponent fibers, to name just a few.

Legal expertise

Bastian Best’s legal experience covers all procedures under the Patent Cooperation Treaty (PCT), the European Patent Convention (EPC) and the German Patent Act (PatentG), where he is involved in counselling clients during the examination procedure, as well as in opposition and appeal proceedings before the European Patent Office (EPO), the German Patent and Trademark Office (DPMA), the Boards of Appeal of the EPO and the German Federal Patent Court (BPatG).

Bastian Best is also very familiar with the judicial requirements under US patent law and has experience in the prosecution of patents in China and India.

Since the legal practise with respect to the patentability of computer-implemented inventions (aka “software patents”) is still evolving and currently subject to a polarizing debate on principles, Bastian Best closely observes the most recent developments in this field, such as the opinion of the Supreme Court of the United States Court on “Bilski v. Kappos” and the former EPO president’s dismissed referral to the Enlarged Board of Appeal of the European Patent Office (G 3/08).
